There are a number of options you may like to consider when planning a bequest to The Taronga Foundation. We recommend engaging a solicitor when making your Will, to ensure your wishes are clearly expressed. A free-of-charge basic Will Service is available for people pledging a bequest to The Taronga Foundation.
For more information about leaving a Bequest in your Will please email Fran O'Brien at fobrien@zoo.nsw.gov.au or call (02) 9978 4573.
If you choose to remember the Taronga Foundation in your Will, you may choose from the following options:
You may choose to leave the residual of your Estate to the Taronga Foundation, once you have made provision for family and friends. This ensures your generosity is inflation-proof and removes the need to put a precise value on your gift.
Suggested wording:
"I give and bequeath to the Taronga Foundation for its general purposes the residue of my Estate and I declare that the receipt of the Chairperson of the Zoological Parks Board of NSW or the Chairperson's delegate shall be sufficient discharge to my Executor/s for this bequest."
You may wish to make a gift of a sum of money to the Taronga Foundation.
Suggested wording:
"I give and bequeath to the Taronga Foundation for its general purposes, the sum of $ ......... and I declare that the receipt of the Chairperson of the Zoological Parks Board of NSW or the Chairperson's delegate shall be sufficient discharge to my Executor/s for this bequest."
Should you wish to give a specific item, such as property, to the Taronga Foundation.
Suggested wording:
"I give and bequeath to the Taronga Foundation for its general purposes all my share and interest in my house know as (insert full address of property) or other my principal house or flat (insert full address) at my death absolutely and I declare that the receipt of the Chairperson of the Zoological Parks Board of NSW or the Chairperson's delegate shall be sufficient discharge to my executors for this bequest."
In the event that your Executor cannot distribute your Estate as planned (for example if a nominated beneficiary predeceases you) then you may choose to nominate The Taronga Foundation as a contingency beneficiary for your bequest having failed.
Suggested wording:
"In the event that any of my nominated beneficiaries should predecease me then their bequest shall not fail but I give and bequeath the share of my deceased beneficiary to the Taronga Foundation for its general purposes and I declare that the receipt of the Chairperson of the Zoological Parks Board of NSW or the Chairperson's delegate shall be sufficient discharge to my executors for this bequest."
You may care to consider the establishment of a Trust whereby your Executor and Trustee holds your Estate upon Trust to pay the income to nominated beneficiaries such as your partner, relative or other next of kin during their lifetime and upon the death of those beneficiaries the assets pass to the Taronga Foundation. Your Will needs to set out detailed provisions for the operation of the Trust. The terms are too long to provide a short suggested wording but your legal adviser will be able to assist you in the appropriate drafting of the Trust provisions.
